There are laws that each state has in place to govern how workers’ compensation benefits are distributed. The Illinois Workers’ Compensation Act gives a detailed explanation as to what the rights are for workers who are injured. This act entitles injured workers to have benefits for:
  • Medical Expenses. Medical expenses are to be covered at 100% of the cost. There is no deductible or co-insurance payments necessary.
  • Partial Permanent Disability (PPD). This is a lump sum settlement that will compensate you for any injuries that led to partial loss of a body part.
  • Permanent Total Disability (PTD). You will get benefits for life if your workplace injury leaves you unable to do any type of work or if you lost the usage of two of the same body parts.
  • Survivor Benefits. If a worker is killed in a workplace accident, their dependents are eligible for benefits.
  • Temporary Total Disability (TTD). You are entitled to a weekly lost wage benefit if you are unable to work while recovering from your injuries. You will receive 66.6% of your average gross weekly wage.
  • Vocational Retraining. If you are unable to go back to work because of your injury, you may be eligible for compensation to retrain you for a new job in a different field.
  • Wage Loss Differential. If you are no longer able to do your job because of a workplace injury and therefore need to take a new job with lower pay, you may be eligible to receive a benefit that is equal to 66.6% of the difference between the average gross weekly incomes of each job.
